Paternity Questioned In Baby's Death

New information released by the Gila County Sheriff's Department indicates that Bruce Ybarra the Pine man charged with second-degree murder in the death of 4-month-old Devon William Hayden Hayes may not be the infant's father.

According to Gila County Detective George Ratliff, the mother, Sarah Hayes, disputes Ybarra's claim that he's the father of the boy, as was reported to the media last week in a sheriff's department press release.

A paternity test is not planned.

"A murder is a murder," Ratliff said. "The relationship doesn't really matter."

On Aug. 15, Ybarra called 9-1-1 and said his "son was not breathing." The infant was taken to Payson Regional Medical Center and was then transferred to Phoenix Children's Hospital where he died Aug. 16 following emergency brain surgery.

While complete results of the autopsy conducted Thursday are still pending, the pathologist who conducted it indicated the "probable cause of death is shaken baby syndrome."

A memorial fund has been established in Devon's name to help the family offset medical and funeral costs. Donations can be made at any Wells Fargo Bank branch in Payson.
