Superior Court Judge Peter Cahill made no decision at Monday's hearing on whether the case against Kevan Kuhlman would be sent directly to trial or reexamined by a grand jury.
As part of a plea agreement, Kuhlman had previously pleaded guilty and received a 20-year sentence for the 2001 murder of his roommate, Susan Birchak. But he later requested the case be remanded because he said he had misunderstood the terms of the agreement.
Cahill did not rule on Kuhlman's request to remand the case to a grand jury because of a procedural question as to whether he could rule on such a remand request.
Cahill found that he could rule on such a request, but no date has been set for a new hearing.
