Revenue Challenge For The Town Of Payson

I have a potentially lucrative revenue challenge for the Town of Payson and/or the Payson Police Department.

When you enter Payson going north on Highway 87, just past the Casino, there is a sign which reads: Engine Braking Prohibited Within Town Limits, Payson Town Code Sec.130.20 Apparently, there are "some" truckers who have a short memory or think they are above the law. Because, about theime they speed through the Tyler Parkway light going east on the 260, they start applying their loud engine-brakes (Jake brakes to some of us).

It is happening all the time, day and night. No big deal, you say?ayson hasigger problems to deal with? then think about this! When the Star Valley photo radar starts up, thereill be more and more truckers braking to slow down so they won't get a speeding ticket. The braking starts in Payson's town limits, violating Payson's town noise code. The penalty is not to exceed $1,000.00. Do the math.

One ticket a day, a week or even a month...seems to me there is a huge amount of town revenue to be accumulated if someone just steps up to the plate and enforces it! Is this a big deal now? It could just be the revenue Payson needs for those "bigger problems."

130.20 (E) It shall be unlawful for the driver of any vehicle to use or operate or cause to be used or operated within the town any mechanical exhaust device designed to aid in the braking or deceleration of any vehicle, otherwise known as engine-braking.

130.99 (B) Any person who violates 103.20(E) shall be guilty of a civil infraction punishable by imposition of a civil sanction not to exceed $1,000.00. (Ord. 560, passed 01-13-00)
